Raj Kumari vs State of H.P. and Others

Sanjay Karol, J.—Petitioner has prayed mainly for the following reliefs:

a) To quash and set aside the verbal termination order by allowing the applicant to continue to teach the pre-primary/nursery class children as Nursery Teacher in the Government Primary School.

b) To direct the Respondents to continue with the Scheme of holding pre-primary/nursery classes in Government Primary Schools for the benefits of small children as this Scheme is not causing any financial hardship on State Exchequer and the same has been smoothly going on since long time with the help of Parents Teachers Association (P.T.A.) under whose control this Scheme is functioning. Or in the alternative the applicant be adjusted somewhere else as Nursery Teacher.

In the affidavit Respondents have averred as under:

That it is further submitted that as per the information received from the Respondent No. 2 Distt. Primary Education Officer, Kangra at Dharamshala that on 20.12.2000 a Distt. Co-ordinate meeting under the Chairmanship of Deputy Commissioner, Kangra at Dharamshala was held and in that meeting the starting of Nursery Classes was opposed on the ground that due to the starting of Nursery Classes, the strength of boys has been decreased in Angan Bari Centre. This fact was brought on record/notice by the Child Development Project Officer. Thereafter in the meeting it was decided that the Nursery Classes should be stopped. Now the Distt. Primary Education Officer, Kangra at Dharamshala have given instructions to all the Block Primary Education Officers to stop and also to remove the teachers appointed/engaged by the PTA without any delay and the copy of information in this regard, as received from the Distt. Primary Education Officer, Kangra at Dharamshala is attached and the same is marked as Annexure R-1.

In view of the stand taken by the Government, based on the policy decision, No. interference at such a belated stage is warranted. Present petition is accordingly dismissed.
