Learned counsels for the parties are in agreement on the issue that the order passed by the learned Single Judge, dated 09.09.2024, whereby direction has been given to the Project Manager, National Highway Authority of India, Roorkee to have the plot inspected and measured its distance from the underpass, and thereafter, pass an order, as per the law, requires to be modified that the plot to be inspected and measured by the Revenue Authority, as the Project Manager is an employee of the NHAI.
The present Special Appeal is being disposed of with a direction to the Revenue Authority, to be appointed by the District Magistrate, Haridwar, to have the plot inspected and measured its distance from the underpass, as per the guidelines dated 26.06.2020, issued by the Ministry of Road, Transport and Highways, Government of India, within four weeks from the date of production of certified copy of this order.
Pending application, if any, also stands disposed of.
