Petitioner has assailed the transfer order dated 26.6.2012 whereby he has been transferred from Killar Division to Bangana Division vice respondent No.4. Petitioner was transferred from Dalhousie to Division Killar, Pangi vide order dated 28.10.2010. He was relieved on 18.11.2010. He joined his duties at Killar Division on 3.12.2010. Petitioner belongs to District Chamba. The post of Superintendent Grade-II is a State cadre. The incumbents appointed on these important posts must be ready and willing to serve in any part of the State. They have no indefeasible right to remain posted at a particular place. Mr. Adarsh Sharma has argued that his client has to superannuate within a period of two years. It is evident from the pleadings that petitioner has always remained posted in District Chamba initially at Killar and thereafter at Dalhousie. The transfer policy framed by the State Government is not statutory. These are mere guidelines. The scope of judicial review in these matters is very limited. The Court can intervene only when the transfer has been made in infraction of any statutory rule or the same is actuated with mala fides. Petitioner has not alleged any specific mala fides. There is no arbitrariness or unreasonableness in the transfer order whereby the petitioner has been transferred from Division Killar to Bangana Division.
Accordingly, we see no merit in the petition and the same is dismissed. However, it is open to the petitioner to make a representation to respondent No.2 for the redressal of his grievance and the same shall be decided by the Engineer-in-Chief in accordance with law within a period of 6 weeks after the receipt of the same. Pending application(s), if any, also stands disposed of. No costs.
