Judgment
Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail in a criminal complaint No.16
dated 01.08.2014 (Annexure P-1), under Sections 419, 420, 467, 468, 471 and 120-B of the Indian Penal Code, pending before the Court of learned
Judicial Magistrate Ist Class, Mohindergarh.
Notice of motion was issued in this case. Respondent No.1 has appeared through his counsel and learned State counsel has appeared on behalf of
respondent No.2-State. They contested this petition.
I have heard learned counsel for the parties as well as learned State counsel and gone through the record.
Perusal of record shows that it is a complaint case and the present petitioner has been summoned by the trial Court. The petitioner is not required for
any investigation or interrogation purposes. He is only to face the trial. Therefore, no useful purpose will be served by sending him to custody.
Keeping in view the facts and circumstances of the present case and without expressing any opinion on the merits of the case; I find merit in this
petition and the same is allowed. The petitioner is directed to surrender before the trial Court within 15 days from today and on doing so, he shall be
released on bail by the trial Court to its satisfaction.
