Raj Kumar and Others vs State of M.P. and Others

S.K. Gangele, J.—Heard. This petition has been filed by the petitioner against the order dated 01-07-2013 passed by the Board of Revenue.

The petitioner has claimed that he is the owner of the land survey No. 314 area 3.963 hectare situate at village Kukretha, Tahsil Ishagarh.

A complaint was made before the Tahsildar that the petitioner had illegally made encroachment over the land of survey No. 314 area 3.963 hectare, situate at village Kukretha, Tahsil Ishagarh, which was the land of the temple and in the revenue record petitioner''s name is not mentioned against the land.

The Tahsildar conducted the enquiry and recorded a finding that the petitioner had made encroachment over the land and the aforesaid land was recorded as of the ownership of the temple as muafi land.

The petitioner in this petition has filed certain khasra entries. From the aforesaid khasra entries, it is clear that the land was recorded as of ownership of the temple. The petitioner has been shown as encroacher. Earlier a notice was issued to the petitioner as encroacher.

In such circumstances in my opinion, there is no illegality in the impugned order. I do not find any merit in this petition. It is hereby dismissed. No order as to costs.
