This matter is taken up through hybrid mode.
At the outset, Mr. Sahu, learned counsel appearing for the Petitioner in the contempt petition submits that petition for recall (I.A. No.16606 of 2022) of order passed in the connected disposed of W.P.(C) No.14099 of 2009 has not been assigned to this Bench for adjudication. Thus, in all fairness, the matter may be placed before the Hon’ble the Chief Justice for appropriate direction.
Mr. Rath, learned Senior Advocate appearing for the Opposite Party-contemnor in the contempt petition and the Petitioner in the recall petition to the connected disposed of writ petition also does not object to the same.
On perusal of the record, it appears that the contempt petition has been assigned to this Bench for adjudication, whereas no such assignment has been made in the disposed of W.P.(C) No. 14099 of 2009, wherein an application (I.A. No.16606 of 2022) to recall the final order has been filed.
In view of the above, Registry may place the records of this CONTC along with disposed of W.P.(C) No.14099 of 2009 before the Hon’ble the Chief Justice for appropriate direction.
