Present criminal miscellaneous application under Section 482 CrPC along with the joint compounding application has been filed for quashing chargesheet, the summoning order dated 15.3.2018 and the entire proceedings of Criminal Case No. 338/2018, State v. Rahul Tripathi, under Section 420 IPC and 66 and 66-C of the I.T. Act, pending in the Court of Chief Judicial Magistrate, Almora.

Accused applicant Rahul Tripathi and the complainant/respondent no. 2 Diwan Singh, duly identified by their respective Counsel, are present in person before this Court.

Compounding application is duly supported by the affidavits of the accused applicant Rahul Tripathi as well as the complainant Diwan Singh wherein it has been stated that parties have entered into a compromise and loss has been compensated to the complainant and the dispute between the accused applicant and the complainant has amicably been settled and now, the complainant has no grievance or grudge against the

accused person and, therefore, he is not interested in prosecuting the accused applicant.

Complainant admits the above facts.

Offences under Section 420 IPC and Sections 66 and 66-C of the I.T. Act are compoundable. Hence, in the above facts and circumstances of the case, the compromise arrived at between the parties is accepted. Compounding application is allowed. Consequently, the impugned chargesheet and the summoning order and the entire proceedings of Criminal Case No. 338/2018, State v. Rahul Tripathi, under Section 420 IPC and 66 and 66-C of the I.T. Act, pending in the Court of Chief Judicial Magistrate, Almora are hereby quashed.

Present miscellaneous application stands disposed of accordingly.

Urgency application (IA 724/2019) stands disposed of.
