Variation of permit and renewal of permit were granted to the petitioner in the meeting of the 1st respondent RTA held on 16.04.2021. The grant was subject to settlement of timings. Notice for convening timing conference was issued. Thereupon the petitioner submitted Ext P6 objections contending that timings for the entire route need not be settled but is necessary only for the varied portion. It is alleging non-consideration of the said objections that the petitioners have approached this Court.

Heard Sri.I Dinesh Menon, learned counsel for the petitioners and Sri. Bimal K Nath, learned senior Government Pleader.

I am of the opinion that it would be sufficient if in the process of settlement of timings Ext P2-existing timings also is considered by the 2nd respondent.

Accordingly it is ordered that, while settling timings for the petitioner pursuant to Ext P4 grant, Ext P2 timings shall also be taken note of. Needless to say that other interested/rival operators shall also be put on notice. Let the process be completed within a period of two months from the date of receipt of a copy of this judgment.
