In pursuance of the directions issued by the Apex Court and guidelines issued by the High Court of Madhya Pradesh in the wake of COVID-19
outbreak, the matter was taken up through video conferencing while adhering to the norms of social distancing prescribed by the Government.
After arguing for some time, when this Court was not inclined to grant the anticipatory bail, learned counsel for the applicant seeks permission of this
Court to withdraw this first application under Section 438 of Cr.P.C. for grant of anticipatory bail moved on behalf of the applicant in Crime
No.338/2020 registered at Police Station- Civil Lines, District- Datia for the offences punishable under Sections 327, 323, 324, 294, 506 and 34 of IPC
with liberty to surrender before the trial Court and apply for regular bail under Section 439 of Cr.P.C. which shall be considered by the trial Court as
expeditiously as possible.
Permission is granted.
With the aforesaid liberty, this first bail application under Section 438 of Cr.P.C. stands dismissed as withdrawn.
