Judgment
Sandeep Sharma, J
Before the case at hand, could be heard and decided on its own merit, learned counsel for the petitioner states that his client, would be content and satisfied in case a direction is issued to learned Senior Civil Judge, Nadaun, District Hamirpur, Himachal Pradesh to decide the applications filed by the petitioner under Order 39, rules 1 and 2 CPC and Order 39 Rule 2-A CPC expeditiously, in a time bound manner.
Consequently, in view of above, present petition is disposed of with a direction to learned Senior Civil Judge Nadaun, Hamirpur to decide the applications filed by petitioner under Order 39 rules 1 and 2 CPC and Order 39 rule 2A CPC, expeditiously, preferably within a period of four weeks.
Learned counsel for the parties undertake to cause presence of their respective clients before learned court below on 5.9.2023, enabling learned court below to do the needful in terms of this order, well within stipulated period.
The petition stands disposed of in the afore terms alongwith all pending applications.
