Judgment
Hemant M. Prachchhak, J
Mr.Champaneri, learned counsel for the petitioner states that he is having certified copy of the record of the Trial Court and seeks permission to produce on record the same. Learned counsel for the petitioner is permitted to produce certified copy of the record of the Trial Court. Learned counsel for respondent no.1 has placed on record the written submission, which is taken on record.
RULE. Mr.Tolia, learned counsel waives service of notice of rule for respondent No.1 – complainant and Mr.Patel, learned Additional Public Prosecutor waives service of notice of rule for respondent No.2 – State of Gujarat.

Mr.Singhvi, learned senior counsel requests the Court to grant interim protection, which is objected by Mr.Nanavaty, learned senior counsel for respondent No.1. Since the Court has finally heard the matter, in the interest of justice, the interim protection cannot be granted at this stage. Hence, the request for interim protection is refused.
In the meantime, Registry is directed to call for the record and proceedings of the case from the District Court, Surat so as to reach this Court on or before 15th May 2023.
