This application is filed under Section 9 of the Insolvency and Bankruptcy Code, 2016.
We have perused the record. This application is filed on 1st September, 2021.
The default amount is stated to be Rs.15,20,003.00/- which is less than Rupees One Crore according to the Notification of the Ministry of Corporate Affairs, New Delhi, dated 24th March, 2020.
In view of the judgment of the Hon'ble NCLAT dated 25th October, 2021 passed in the matter of Jumbo Paper Products vs. Hansraj Agrofresh Pvt. Ltd., this application is not maintainable. Accordingly, C.P. (IB) 155 (AHM) 2021 stands dismissed and disposed of.
However, an Appeal against the said judgment is pending before the Hon'ble Supreme Court. Hence, subject to the outcome of the decision of the Hon'ble Supreme Court in the said appeal, the petitioner is at liberty to get revived this application.
