Judgment
Pranay Verma, J
By this petition, the petitioner has prayed for the following reliefs :-
"(1) That by issuing a writ of Mandamus or any other appropriate writ/direction/ order to allow the present writ petition by directing to the respondents to issue PPO/GPO to the petitioner by extending the benefit of Full Pension and Gratuity as well as other retiral dues on attaining the age of superannuation.
(2) That by issuing a writ of Mandamus or any other appropriate writ/direction/ order the Charge sheet issued on 23/10/2020 (Annx. P/2) may kindly be dropped by exonerating the petitioner or respondents may kindly be directed to conclude the Departmental Proceedings within two months.
(3) That consequently respondents may kindly also be directed to release the amount of Gratuity, Full Pension and other reitral dues along with interest @12% per annum.
(4) Any other relief which this Hon'ble Court may deem fit in the facts and circumstances of the case, in favour of the petitioner and against the respondents."
Learned counsel for the petitioner has submitted that the departmental enquiry against the petitioner is pending for past more than two years and only 90% of the pension has been released but the gratuity and other amounts to which the petitioner is entitled have not been released to him. It is submitted that the departmental enquiry be directed to be decided expeditiously and other benefits to which the petitioner is entitled be also directed to be paid to him in view of the representations which the petitioner has already made to the respondents which have not been decided.
3 . Learned counsel for the respondents/State has submitted that the appropriate orders in the matter shall be passed.
Thus in view of the available facts of the case, the respondent No.1 is directed to advert to and decide the representations dated 20/6/2023 (Annex. 3 P/7), 7/2/2024 (Annex.P/8) of the petitioner by specifically taking into account the provisions of Section 64 of the M.P. Civil Services (Pension) Rules, 1976 within a period of 3 months from the date of receipt of the certified copy of this order by passing a reasoned and a speaking order.
5 . It is further directed that the respondents shall take all possible endeavours and shall conclude the departmental enquiry pending against the petitioner preferably within a period of 4 months from the date of receipt of certified copy of this order.
With the aforesaid, without expressing any opinion on merits, petition stands disposed off.
