Judgment
Heard Mr. Mohit Prakash, learned counsel for the petitioner and Mr. Rakesh Ranjan, learned A.P.P. for the State.
Defects as pointed out by the office are ignored. The petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection
with Gumla P.S. Case No. 198/2020.
The marriage of the informant was solemnized with the petitioner on 25.04.2012. It has been alleged that the petitioner used to regularly assault her
and she was forced to sign on the divorce papers.
The petitioner had filed a suit for dissolution of marriage with mutual consent and certain conditions were put forward which according to the
petitioner was fulfilled by him. The suit was dismissed since the informant had expressed her desire to resume marital life with the petitioner.
Subsequently a fresh suit for dissolution of marriage was filed by the petitioner being Original Matrimonial Suit No. 518/2019.
It appears that after notice was issued and the informant appeared in the suit she had subsequently filed the complaint case which on being sent to the
Police u/s 156(3) Cr.P.C. got registered as a First Information Report.
Regard being had to the aforesaid circumstances, I am inclined to extend the privilege of anticipatory bail to the petitioner. The petitioner accordingly
is directed to surrender before the learned court below within a period of four weeks and on his surrender, he shall be released on bail on furnishing
bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
Magistrate, Gumla in connection with Gumla P.S. Case No. 198/2020, subject to the conditions as laid down under Section 438(2) of the Code of
Criminal Procedure.
This application stands allowed.
