Judgment
M. Katju, J.—The petitioners were granted an arm licence in Nagaland for a rifle as is evident from Annexures 1 and 2 to the petition. Their licences were cancelled and now they want to sell their firearm for which a representation was made to the District Magistrate Badaun for permission to sell it vide Annexure 1 to the petition. Since the permission was not granted, this petition has been filed.
Having heard counsel for the parties, I am not inclined to interfere in this matter. It is surprising that the petitioners who are residents of Badaun obtained arms licences from Nagaland. Such a licence is not valid as held by the Court in 1995 ALJ 928 which decision was upheld in Special Appeal No. 657 of 1996, decided on 4996.
As regards the prayer for selling the guns the petitioners have already made representations before District Magistrate, Badaun vide Annexure 1 to the petition, and I direct that the said representation be decided expeditiously by the District Magistrate, Badaum in accordance with law.
With these observations this petition is finally disposed of.
