Judgment
Ajay Rastogi, J.—Notices were issued by this Court on 23.06.2009 and as per office report service was complete before 14.09.2009. No reply to the writ petition has been filed on behalf of the Respondents so far.
This is a joint petition filed by 16 Petitioners and in para 9 of the petition a statement has been made with respect to year from which they are working in the office of CM Cell on the post of Data Entry Operator-cum-Informatic Assistant. Earlier also the matter came up on misc. application filed by Petitioners with the grievance that their salary from June to September,2010 has been withheld by the Respondents. However, it was informed to this Court after filing of the application that their salary has been released
Again the matter has come up on misc. application-27318 dt.16.11.2010 and the Petitioners made a complaint that two of the Petitioners (5 & 16) have been asked not to come to their respective jobs any further. After copy of the application was served upon the Respondents time was sought to file reply. However, reply to the writ petition and of the present application as well has not been filed.
Counsel for Respondents today also seeks further time to file reply to the writ petition and so also of the present misc. application.
Counsel for Petitioners submits that sufficient time has already been granted to Respondents'' counsel and without any fault of Petitioners No. 5 & 16 they have been restrained from discharging their duties who are working on the post of Data Entry Operator-cum-Informatic Assistant since 1999/2006 respectively.
Taking note thereof, this Court considers it appropriate to direct the Respondents to allow them to continue on the post which they are holding as referred to in para 9 of the writ petition, till further orders.
List in the month of January,2011, as prayed. In the meanwhile, Respondents may file reply to the writ petition and of the present application as well.
