Judgment

It is the complaint of the petitioners that the recommendation of Hubballi – Dharwad Urban Development Authority for allotment of sites is pending consideration by the Government and hence an appropriate direction be issued to the first respondent to take necessary decision on the said recommendation of the Hubballi – Dharwad Urban Development Authority.
It is the case of the petitioners that they had lost their residential accommodation for the purpose of up-gradation of Hubbali Airport and in view of their social status they were promised an alternative site would be given to them notwithstanding the fact that they had received the compensation.
It is their further case that Hubballi – Dharwad Urban Development Authority accepted the fact that the petitioners, given their social background, would be unable to purchase alternative sites and therefore it would be necessary to allot them the sites and had accordingly sought the approval of the State.
It is also the case of the petitioners that in similar cases, the Government has accorded approval and sites have been allotted to similarly placed persons.
In view of the said submission and in the light of the recommendation by the Hubballi – Dharwad Urban Development Authority, it would be necessary to direct the State Government to consider the recommendation of the Hubballi – Dharwad Urban Development Authority made vide Annexure-C within a period of three months from the date of receipt of a certified copy of this order and pass an appropriate order in accordance with law. The State shall keep in mind the similar approvals, if any, that it had granted in similar cases.
The writ petition is accordingly disposed off.
