Judgment

This is an application filed under Section 438 of the Cr.P.C by the second accused in Crime No.127/2021 of Aroor Police Station, which was
registered alleging offence punishable under Sections 341, 294(b), 323, 324 and 308 read with Section 34 of the IPC. The place of occurrence is inside
Hotel Residency, Aroor, a bar hotel.
The learned counsel submits that, he has no role in the incident that caused injury to the defacto complainant; a tussle had occurred between the
first accused and the defacto complainant.
Whatever it may be, the learned Public Prosecutor has submitted that on completion of investigation, charge sheet has been laid showing the
petitioner as absconding accused.
In the light of the fact that the charge sheet has already been laid, custodial interrogation cannot be required. Therefore, he is at liberty to surrender
before the Jurisdictional Court within ten days from today and he shall be released on bail on executing bond for Rs.50,000/-(Rupees Fifty thousand
only) with two solvent sureties each for the like sum to the satisfaction of the Court; shall not try to contact or influence the witnesses or tamper with
the evidence and shall not involve in any crime during the period on bail; He shall appear before court as and when necessary.
Bail application is allowed as above.
