Judgment
Sujoy Paul, J.—Heard. The petitioner is transferred by order dated 15.07.2013 from one Panchayat to another. It is challenged on the ground that petitioner''s wife is a Anganwadi worker and as per Government policy husband and wife should be retained at the same place.
I have heard learned counsel for the parties.
Husband and wife being government employees have no enforceable right to remain posted at one place as held by the Apex Court in Union of India and Others Vs. S.L. Abbas, as under:--
...The guidelines say that as far as possible, husband and wife must be posted at the same place. The said guideline however does not confer upon the Government employee a legally enforceable right.
Thus, in the light of aforesaid, petitioner has not such enforceable right. Thus, I find no reason to interfere in this petition. Even otherwise policy cannot be enforced in a writ petition. Considering the aforesaid, I am only inclined to observe that petitioner''s representation Annexure P/2 be decided by respondent No. 3 expeditiously within three weeks. With the aforesaid, petition is disposed of.
