Judgment
R. Basant, J.—The Petitioner - a woman aged 45 years, has come to this Court with this petition for issue of directions under Article 226 of the Constitution to Respondents 1 and 2 to afford protection to the Petitioner for the peaceful and orderly conduct of the wedding of the daughter of the Petitioner on 2/6/11 and the wedding party to be held on 31/5/11.
According to the Petitioner, all arrangements have been made for the wedding of the daughter. The 3rd Respondent is threatening to illegally obstruct the peaceful conduct of the wedding on 2/6/11 and the wedding party on 31/5/11.
There was a Vanitha Swyam Sahaya Sangham. The said Sangham owes liabilities to the Bank. The 3rd Respondent''s wife is also a member of the Sangham. The 3rd Respondent wants the Petitioner to discharge the entire liability to the creditor. As the Petitioner is unable to do the same, she is being threatened that the marriage of her daughter will be illegally obstructed.
The matter came up for admission hearing on 27/5/11. Notice was ordered to the Respondents. The 3rd Respondent has been served. There is no appearance for the 3rd Respondent.
We are satisfied, in these circumstances, that the Petitioner''s prayer can be allowed. There is absolutely no indication to suggest that there is any other reason for the apprehended obstruction on the part of the 3rd Respondent.
The learned Government Pleader submits that Ext.P2 complaint has been received by the police and necessary action shall be taken to afford protection for the Petitioner.
This writ petition is, in these circumstances, allowed. Respondents 1 and 2 are directed to afford adequate and sufficient police protection to the Petitioner for the peaceful and orderly conduct of the marriage of the daughter of the Petitioner on 2/6/11 and the wedding party to be held on 31/5/11.
Hand over a copy of this judgment to the learned Counsel for the Petitioner.
