This matter is taken up through hybrid mode.

The Petitioners in this writ petition pray for the following relief:

“It is therefore prayed that your Lordship will be graciously pleased to direct the Opp. Party No.2 to allow the Petitioners to sale their share Ac.0.70 decs. 1 Kadi out of total land recorded in Khata No.102 of mouza-Bamburi in Khata No.190 of mouza-Barala in Khata No.393 under P.S. Cuttack Sadar vide Annexure-1 to 4 in order to meet their daughter’s marriage, treatment, repayment of hand loans and construction of house.

And for this act of your kindness, the Petitioner as in duty bound shall ever pray.”

It appears from the averments as well as prayer made in the writ petition that the Petitioners seek permission to alienate the property, as aforesaid. It further appears that no sale deed has yet been executed by the Petitioners in respect of the property.

In view of the above, the relief sought for in the writ petition is misconceived.

At this stage, learned counsel for the Petitioners prays for withdrawal of the writ petition.

Accordingly, this writ petition is dismissed as withdrawn.
