ORDER

This Appeal is filed against order dated 15.03.2025 passed by the Learned Presiding Officer, DRT, Coimbatore in IA 1336/2025 in SA 278/2025, directing the Respondent Bank to put on hold its confirmation of sale on payment of Rs.20 Lakhs by Appellant, in two instalments. Against said conditional order, this Appeal is filed.

SA 278/2025 was filed to set aside the sale notice dated 24.02.2025 and for other reliefs. The main SA is still pending.

Learned Presiding Officer recording the readiness and willingness expressed by the Appellant to pay Rs.20 Lakhs to avert confirmation of sale, directed the Appellant to pay a sum of Rs.10 Lakhs on or before 21.03.2025 and another sum of Rs.10 Lakhs on or before 28.03.2025. Without complying with these conditions, this Appeal is filed.

Learned Counsel for Respondent submitted that the property has been sold and sale confirmed and sale certificate issued subsequent to the non-compliance of the conditional order.

In the said circumstances, this Tribunal is of the view that there is no merit in this Appeal and this Appeal is liable to be dismissed with a direction to the Learned Presiding Officer, DRT, Coimbatore, to dispose of the SA, on merits and in accordance with law, as expeditiously as possible.

Accordingly, this Appeal in M.A (SA) :87/2025 is dismissed. Both parties shall bear their own costs. All pending IAs, if any, stand closed.
