The intimation regarding the order dated 22.02.2021 passed by the Hon’ble High Court of Judicature at Madras in W.P. No.2665 of 2021 in the

matter of “R.Chinnakannan @ Vallal RCK Vs. Union of India & Ors.â€, has been filed by the learned counsel for the appellant before this

Tribunal on 01.03.2021 along with Web Copy of the said order. But the same has come to the knowledge of the undersigned on 22.03.2021 as the

undersigned was on leave from 01.03.2021 to 19.03.2021 and resumed duty on 22.03.2021, 20/21.03.2021 being Saturday and Sunday.

The Hon’ble Madras High Court has asked this Tribunal to dispose of the appeal within a period of two months from the date of receipt of a copy

of that order. The copy of the order has not yet been received from the Hon’ble High Court. It is submitted by the learned counsel for the

appellant that the Hon’ble High Court has already dispatched the said order dated 22.02.2021 to this Tribunal. It is also submitted by the learned

counsel for the appellant that they have already applied for the certified copy of the said order.

The appeal is posted today along with the miscellaneous applications for modification of the order dated 09.03.2020 and miscellaneous application for

additional grounds.

During the course of hearing the learned counsel for the appellant submitted that the appellant do not press the aforesaid modification and additional

grounds applications in the present circumstances. The same is considered. In view of the above, the aforesaid modification applications and additional

grounds application are dismissed as not pressed.

On perusal of the record it is seen that pleadings are yet to be completed. The learned counsel for the respondent (ED) seeks three weeks time to file

reply to the appeal on the ground that the Investigating Officer (I.O.) of the case has been transferred. The learned counsel for the appellant raised

objection for grant of three weeks time and submitted that the respondent may be granted only two weeks time. Considered the submissions. The case

pertains to Mumbai Zone of the Enforcement Directorate and that the I.O. has been transferred, therefore, in the interest of justice, as the last

opportunity, the prayer of the respondent is granted. Let the reply be filed by the respondent (ED) within three weeks from today, with an advance

copy to the other side. The learned counsel for the appellant has sought one week time to file rejoinder, if any, after receipt of the copy of the reply to

the appeal. The same is also considered and allowed.

The appellant is directed to file Certified Copy of the order of the Hon’ble Madras High Court at the earliest.

With the consent of both the parties, list the appeal on 23rd April, 2021 at 02:30 PM.
