Straight, Offg. C.J, Oldfield, Brodhurst and Tyrrell, JJ.—We assume, for the purpose of answering this reference, that there was a withdrawal of the case; and we desire only to say that we are satisfied that the person charged with the prosecution had not the power of a Public Prosecutor, with regard to withdrawal, u/s 491 of the Criminal Procedure Code.
