Judgment
Dilip Gupta, J.—The relief claimed in this petition is for a direction upon the Respondents to admit the Petitioner to Special B.T.C. Training Course 2007.
It is stated that the Petitioner was not considered for admission to the aforesaid B.T.C. Training Course as she obtained B.Ed. Degree from Barkatullah University, Bhopal.
It is submitted by Learned Counsel for the Petitioner that in view of the Full Bench decision of this Court in Jitendra Kumar Soni and Ors. v. State of U.P. and Ors. 2010 (4) ESC 2441, the said Degree can be considered for the purposes of admission to the B.T.C. Training Course.
Learned Standing Counsel appearing for the Respondents relied upon paragraph 31 of the Full Bench judgment and has submitted that No. relief can be granted to the Petitioner in view of the Full Bench judgment in Jitendra Kumar Soni (supra) as the Full Bench had granted relief only to such candidates whose writ petitions were pending disposal in the High Court as is clear from paragraph 31 of the judgment. He further submitted that even otherwise, the B.T.C. Training Course 2007 has come to an end.
In paragraph 31 of the Full Bench judgment in Jitendra Kumar Soni (supra), the Court observed:
The Government has issued orders closing these courses except for those, whose applications were rejected on the ground that they did not possess the L.T./B.P.Ed./D.P.Ed./C.P.Ed. from institutions in U.P. and the matters are pending before this Court. With respect to the Special B.T.C. Courses for the years 2004, 2007 or 2008, if the Petitioners, whose petitions are pending, are eligible, they shall be considered for training for the Special B.T.C. Courses, which shall be commenced within a reasonable period.
It is the not the case of the Petitioner that she had filed any writ petition which was pending disposal when the Full Bench decision was delivered.
In view of the aforesaid Full Bench decision of the Court, No. reliefcan be granted to the Petitioner.
The writ petition is, accordingly, dismissed.
