Applicant/Pushpendra Chaturvedi has filed this fourth bail application under Section 439 of CrPC in connection with Crime No.557/2020 under Sections 294, 302, 323, 506, 34 of IPC registered at police station Maihar, District Satna (M.P) and applicant is in custody since 09/08/2020.
Shri Ajay Kumar Tamrakar, learned PL submits that after giving him treatment at AIIMS Bhopal, applicant has been discharged to Sub Jail Maihar and he will be given treatment as per advice of the doctor locally. Applicant is suffering with psoriasis, which is a skin disorder for last 6-7 years as per prescription of Dr. Renu Roy.
Shri Ayur Jain, learned counsel for the applicant makes an appeal to release the applicant at least for 15 days but I am of the opinion that since applicant can be given treatment in jail, psoriasis is a skin disorder, which cannot be cured within 15 days. Therefore, this is not a fit case to release applicant on bail. Thus, application fails and is dismissed.
