Judgment
Hon’ble Ravindra Maithani, J. (Oral)
Instant Habeas Corpus Petition has been filed for producing the corpus, Manpal Singh, who happens to be the husband of petitioner no. 1 and father of petitioner no. 2, and who, according to the petitioners, has illegally been detained by respondent no. 4, Bhanu Pratap Singh, the son of the corpus.
Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioners would submit that the mental health of the corpus is not fine; he repeats whatever he speaks; and also petitioner no. 1 intends to stay with the corpus, who is her husband.
Learned counsel appearing for respondent no. 4 would submit that the corpus is staying willingly with respondent no. 4 and he is mentally fine. He would submit that, in fact, the corpus has also filed his own affidavit.
State has also filed a counter affidavit.
The Court interacted with corpus, Manpal Singh, who is on a wheelchair. He is oriented to the time, place, date etc. He is responding properly and submits that today is 29th September, 2026 and it is about 1:15 in the noon. This he said without looking at the watch, when the time was 1:00 p.m. He also states that he is appearing before the High Court, Nainital. According to him, he served as a Senior Class-I Officer in the Central Public Works Department and at that time, they were staying at Pandara Road, New Delhi. He is repeating the things twice or thrice, but otherwise, he is well-oriented. According to him, he is willingly staying with his son, Bhanu Pratap Singh.
Although on behalf of the petitioners, it is submitted that the corpus, Manpal Singh, is not mentally well, but this Court cannot conclude about it.
As stated, the corpus, Manpal Singh, is responding to the Court's query and interacting; he is well-oriented about everything around him.
Since the corpus, Manpal Singh, has stated that he is willingly staying with his son, respondent no. 4, Bhanu Pratap Singh, there is no reason to make any interference in this petition.
The Habeas Corpus Petition stands disposed of accordingly.
