The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking directions to respondent authorities to discharge their statutory and public duty cast upon them under Section 197 Code of Criminal Procedure, 1973 (‘Cr.P.C.’). He is also seeking directions to respondents to pass an order on his representation dated 17.10.2025 seeking sanction/lifting of statutory bar for prosecution of public servants.
The petitioner is claiming that he is a public-spirited person. He filed representation dated 17.10.2025 before Governor of State of Punjab seeking sanction under Section 197 Cr.P.C with respect to cases pending before learned Chief Judicial Magistrate, Chandigarh relating to sacrilege. The Office of Governor, Punjab has forwarded the matter to State Government. As per his information, it is pending before Additional Chief Secretary (Litigation), Punjab. The respondent has taken no action on the said representation.
The petitioner who is present in person submits that he is not respondent should act upon application moved by Investigating Agency seeking sanction under Section 197 Cr.P.C. The respondent is sitting over the matter though couple of years have passed away.
Faced with aforesaid prayer, Mr. Aman Dhir, Deputy Advocate General, Punjab, who on advance notice is present in Court on behalf of respondent-State, submits that matter is under consideration and competent authority would decide the matter in one or another way in accordance with law within three months from today.
The petitioner agrees to the aforesaid arrangement.
In the wake of statement of both sides, the petition stands disposed of.
