Judgment
Arindam Lodh, J
This is a bail application filed by the petitioner under Section 439 Cr.P.C. for granting bail to the accused petitioner who has been arrested on 12.09.2023 in connection with Kailasahar PS Case No. 117 of 2023 registered under Sections 120(B)/468/471/409 of the IPC and Section 13(A) of the Prevention of Corruption Act, 1988.
Mr. P. Majumder, learned counsel for the petitioner has submitted that the accused petitioner is innocent and has been falsely implicated with the instant case. More importantly, learned counsel has emphasized that the alleged defalcated amount has been deposited by the accused petitioner with the department concerned. Mr. Majumder, learned counsel has further submitted that the accused petitioner has been in custody for more than 30 days after his arrest, and in the meantime, the investigation has almost been completed, and at present, there is no necessity to continue with his detention in jail custody.
At this juncture, Mr. Ratan Datta, learned PP has requested this court to take certain instructions and for this purpose he prays for an adjournment of the matter.
