Office note dated 29.03.2023 put up by the Registry indicates that unserved notice returned back from opposite party nos.2 to 7 with report of India Post “this party not attended this village, so returned to senders.”

Though this Court is unable to follow the comments put up by the Department of the India Post, the learned counsel for the petitioners as well as the learned Standing Counsel for the State also expressed they are helplessness regarding interpretation of such note by the Postal Department.

In view of the fact that unserved notices have been received back in the Registry, learned counsel for the petitioners prays for leave to take fresh notice by Registered Post with A.D.

Prayer is allowed.

Let fresh notice be issued to the opposite party nos. 2 to 7 in their present correct address by Registered Post with A.D. fixing returnable date on 04.05.2023, requisites for which shall be filed within seven working days. The unutilized copies be utilized.

List on 12.05.2023.

The interim order passed earlier shall continue till the next date.

Issue urgent certified copy as per rules in course of the day.

Copy of the order be uploaded.
