Judgment
1. Heard learned counsel for the Petitioners, learned counsel for the State and learned counsel for the Informant.
The Petitioners are accused in connection with C.T. Case No.162 of 2025, pending on the file of learned J.M.F.C, Baripal, arising out of Ramchandrapur P.S. Case No.423 of 2025 for alleged commission of offences under Sections 296/108/61(2)/351(2)/3(5) of BNS.
Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. case is pending in any other Court.
Being aggrieved by the rejection of his application for bail U/s.483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) by the learned District and Sessions Judge, Jajpur by order dated 15.04.2026 in the aforementioned case, the present BLAPL has been filed.
It is submitted by the learned counsel that the Petitioners efforts to settle an intra-family feud has resulted them being cited as accused and it is stated that though initially FIR was instituted, inter alia, under Section 103(1) of BNS, after investigation charge sheet has been submitted under Section 108 of BNS and the offences related to SC/ST (PoA) Act also does not find place in the charge sheet.
It is further submitted that since the Petitioners are in custody from 25.02.2026 and charge sheet has been filed, their further continuance in custody is not warranted in fact is punitive.
Learned counsel for the State opposes the prayer for bail and submits that because of the conduct of the Petitioners, the husband of the complainant was driven to end his life. Hence, no leniency ought to be shown.
Learned counsel for the Informant also supports such submission and states that Petitioners do not deserve any leniency.
This Court perused the materials on record including the statement of the informant, the wife of the deceased.
Considering the materials on record, this Court directs the Petitioners to be released on bail on such terms to be fixed by the learned Court in seisin.
Accordingly, the BLAPL stands disposed of.
