Learned counsel appearing for the petitioners submitted that the shop owners/shop keepers of the Arunodaya Market Complex and Golden Jubilee Market Complex approached authority concerned on 23rd September, 2025 vide Annexure-11with a request not to demolish the structures, which would affect their livelihood.

1.1. He submitted that this Court after causing enquiry with regard to the necessity to demolish the structure for the purpose of widening the road through the Court Commissioners, highlighting their suggestions vide order dated 23rd June, 2025 of this Court in W.P.(C) No.7347 of 2025 (Purna Chandra Barik and others Vs. State of Odisha and others) issued certain directions to the authorities concerned.

1.2. He vociferously submitted that without adhering to such directions issued by this Court, the authorities of Balasore Municipality have taken steps to demolish the structure.

At this stage, learned Additional Standing Counsel appearing for the State seeks accommodation to file response.

Issue notice to the opposite parties.

Mr. Pravat Kumar Panda, learned Additional Standing Counsel appears and waives issue of notice on behalf of opposite party nos.1 to 3 and 5 to 8.

Issue notice to opposite party no.4 by Speed Post with A.D., requisites for which shall be filed by Wednesday (1st October, 2025). In the event of furnishing such requisites within the period stipulated, the Office shall send notice to the said opposite party no.4 by fixing a short returnable date.

Since the notice to vacate the market complexes in question by public announcement has been given without serving individual notice, keeping in view the order dated 23rd June, 2025 passed in W.P.(C) No.7347 of 2025, it is directed that the opposite parties shall not proceed with the eviction/demolition of the shops situated in the Arunodaya Market Complex and Golden Jubilee Market Complex till the next date.

Awaiting response from the opposite parties, list this matter in the week commencing 27th October, 2025.
