This is a petition under Article 226 /227 of the Constitution of

India, praying for a writ of mandamus directing the respondents to pay

compensation to the petitioners for having obtained possession of their land

holding for extension of metro project from YMCA chowk to Ballabgarh.

And also to prohibit the respondents from using the land of the petitioners

for the alleged purpose without awarding an adequate compensation.

It is urged that without there being any valid acquisition, the

respondents have obtained possessions of the land owned by the petitioners,

and even though the petitioners do not intend to question the alleged

acquisition, but they must be awarded suitable compensation for their land.

However, on being asked, learned counsel for the petitioners concedes that

before filing this petition, the petitioners have never represented to the

respondents even once as regards their grievance.

Faced with this, learned counsel for the petitioners submits that

he be permitted to withdraw the petition so as to enable the petitioners to

move a representation to the respondents, and the respondents be directed

that in the event any such representation is made, the same shall be decided

within a specified time.

In conspectus of the above, the petition is dismissed as

withdrawn with liberty to the petitioners to make a representation to the

respondents for redressal of their grievance. And in the event any such

representation is made within a period of two weeks from today, the

respondents shall consider and decide the same within a period of six weeks

from the date of its receipt in accordance with law.
