These contempt petitions have been preferred by the original petitioners for the alleged breach of order dated 16th January, 2019 passed by this Court in W.P. (C) 392/2019, W.P. (C) 394/2019, W.P.(C) 396/2019 and W.P. (C) 363/2019 by the respondents herein.

The respondents have tendered to this Court counter-affidavits filed by Mr. B.L. Natiya, Chairperson of Northern Regional Committee of National Council for Teacher Education.

The said affidavits are taken on record and a copy thereof has been given to learned counsel for the petitioners.

Looking to the affidavits filed by Mr. B.L. Natiya, Chairperson of Northern Regional Committee(NRC) in CONT.CAS(C) 868/2019, CONT.CAS(C) 871/2019, CONT.CAS(C) 872/2019 and CONT.CAS(C) 873/2019, especially paras 3 (ix) onwards, it appears that now the respondents have started holding a meeting for considering the claims of these applicants/petitioners for grant or otherwise of the recognition, as per the order dated 16th January, 2019, passed by this Court in W.P. (C) 392/2019, W.P. (C) 394/2019, W.P.(C) 396/2019 and W.P. (C) 363/2019.

This process is being initiated by the respondents de hors the requirement of NOC as directed by this Court by the aforesaid order dated 16th January, 2019.

During the process of considering the grant or otherwise of the recognition by the respondents de hors the requirement of NOC, notices have been issued by the respondents to verify whether the deficiencies, as pointed out in the notices, are in existence, or not, at the applicants'/petitioners colleges.

The applicants/petitioners have given a reply to the show cause notices and as a last chance one more notice has been issued to all the applicants/petitioners, which may be a compliance letter by this applicants/petitioners to the respondents because there are several deficiencies pointed out by the respondents like, registration of the four colleges in one premises etc.

Thus, the process to consider the claim of these applicants/petitioners for getting recognition without requirement of NOC is already going on and hence there is no wilful disobeyance of the order dated 16th January, 2019 passed by this Court in W.P.(C) 392/2019, W.P.(C) 394/2019, W.P.(C) 396/2019 and W.P.(C) 363/2019 by the respondents herein.

Hence, these contempt petitions are hereby dismissed.

The officers of the respondent/NCTE, namely, (i) B.L. Natiya, Chairperson of NRC, (ii) Vijay Kumar R., RD, ERC and (iii) Mr. Pawan Sharma, Legal Consultant NRC are present in person. Their presence is not required till further orders.
