Judgment
Arindam Lodh, J
Heard Mr. P. K. Biswas, learned senior counsel assisted by Ms. S. Debbarma, learned counsel appearing for the petitioners. Also heard Mr. D. Bhattacharjee, learned GA assisted by Mr. S. Saha, learned counsel appearing for the respondents-State.
By filing this writ petition, the petitioners have prayed for the following reliefs:
“(i) Admit the instant writ petition,
(ii) Call for the records relevant from the custody of the respondents;
(iii) Issue RULE calling upon the respondent to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued directing the respondents to directing the respondents to give effect to the notification under No.F.9(13)-REV/SEQ/DIV/08 dated 19.02.2019 under section 4 of the LA Act followed by declaration under the same number dated 13.07.2019 under Section 6 of the LA Act by which an amount of Rs.12,29,811/- was granted as compensation including solatium and statutory interest for land measuring 0.106 acres of dukan (tilla) class under Khatian no. 34519, 34522, 34525, 34526, 34527, 34528, 34529, 34515/Jer 1209, Plot nos. 288686/P, 228688/P, 28703/P, 28704/P, 28706/P, 28707/P, 28722/P, 28723/P, 28725/P, 28725/P, 28726/P, 28727/P, 28737/P, 28739/P, 28742/P, 28743/P, 28744/P, 28745/P, 28667/P @ Rs.80 lakh per acre i.e. Rs.32 lakh per kani;
(iv) Issue RULE calling upon the respondent to show cause as to why a Writ of Mandamus and/or in the nature thereof, shall not be issued directing the respondents to quash/set aside the letter under no. F.B/N/W/LA/BLG/23/08/19,536, dated 08.12.2021 issued by the LA Collector, West Tripura, Agartala.
(v) After hearing the parties be pleased to make the Rule absolute, issuing direction to the respondents.”
Mr. D. Bhattacharjee, learned GA has submitted that he will check up the issues, as raised by the petitioners, and has prayed for some accommodation.
Prayer is allowed.
