Judgment

This matter is taken up through Hybrid arrangement (video conferencing/physical mode).
This is an application for interim bail on the ground for enabling the petitioner to submit his thesis paper before the concerned authority of Maharaj Vinayak Global University, Dhand, Amer, Jaipur, Rajasthan. A sample copy of the thesis paper has been enclosed thereto.
Today, learned counsel for the State has filed counter affidavit to the interim bail application wherein in paragraph nos.6,7 & 8 read as follows:
“6. That, even though 32 numbers of prosecution witnesses have been examined during trial of the case, many more material prosecution witnesses are yet to be examined. In the event the petitioner is released on bail, he shall intimidate prosecution witnesses and shall thus tamper prosecution evidence for which his bail petition deserves rejection.
That, no document has been filed in support of contention of the petitioner that he has a valid registration to pursue his Ph.D. degree and to submit a thesis. It is pertinent to mention herein that unless and until a scholar intending to pursue Ph.D. degree registers himself procedurally through a qualified guide, he cannot be allowed to, submit a thesis. Thus, claim of the petitioner being misconceived, his bail petition is liable to be rejected.
It is ascertained from the Superintendent of Jail, District Jail Balangir that the petitioner has not submitted any registration number in support of his Ph.D. course nor any order has been passed by the concerned Court regarding his Ph.D. Course. There is no evidence regarding of his Ph.D or regarding his guide under whom he is pursuing Ph.D.”
A copy of the counter affidavit has been served on the learned counsel for the petitioner in Court today.
Learned counsel for the petitioner has filed the Provisional Registration Letter of Maharaj Vinayak Global University, Dhand Amer, Jaipur, Rajasthan dated 22.08.2015 in Court today.
A copy of the same has also been handed over to the learned counsel for the State.
Learned counsel for both the parties want to obtain instruction as to what was the time period prescribed to submit the thesis paper of the petitioner in pursuance of the Provisional Registration Letter of Maharaj Vinayak Global University, Dhand Amer, Jaipur, Rajasthan dated 22.08.2015 and whether any extension was sought for and has been given thereto or not.
Put up this matter in the week commencing from 10th July 2023.
A free copy of the order be handed over to the learned counsel for the State for compliance.
