Heard learned counsel for the parties.
Learned counsel for the petitioners states that the petitioners would be satisfied if the revision petition is disposed of by directing the learned
Arbitrator to provide opportunity to the petitioners to lead evidence in support of the validity of clause 25(viii) of the Arbitration Agreement as also as
to whether the same was on the basis of mutual agreement between the parties or was subsequently interpolated by the petitioners and to decide the
matter in respect thereto in terms of order of this Court dated 17.02.2016, in FAO No.604 of 2012.
Learned counsel for the respondents states that he has no objection to the aforementioned course of action proposed by learned counsel for the
petitioners.
In the circumstances, the revision petition is disposed of by requesting the learned Arbitrator to grant opportunity as deemed appropriate to the
parties for leading evidence in terms of order dated 17.02.2016, passed by this Court in FAO No.604 of 2012, with regard to the validity of clause
25(viii) of the Arbitration Agreement and to take a decision in respect thereto, in accordance with law as expeditiously as possible, preferably within a
period of three months from the date of receipt of certified copy of this order.
Revision petition disposed of in the aforementioned terms.
