Judgment
The present appeal is filed to challenge the impugned order dated 09.04.2026 passed by DRT-II, Delhi in S.A. bearing TSA No. 13/2025 titled as Rakesh Kumar Gupta v. Punjab National Bank whereby, the DRT-II, Delhi allowed the application bearing I.A. No. 888/2026 and restrained the appellant from taking any action against the S.A. applicant i.e. respondents in the present appeal.
The counsel for the appellant primarily argued that the DRT-II, Delhi in impugned order dated 09.04.2026 had given conclusive findings on each and every issues which are to be decided at the time of final adjudication of S.A. bearing TSA No. 13/2025. It is further argued that the findings and observations in the order dated 09.04.2026 may influence the DRT-II, Delhi at the time of final disposal of the said S.A.
DRT-II, Delhi in the impugned order dated 09.04.2026 has categorically observed that the impugned order dated 09.04.2026 is only the prima facie view and each and every issue shall be decided at the time of final disposal of S.A. bearing TSA No. 13/2025.
The present appeal is disposed of with the direction that the DRT-II, Delhi shall decide the S.A. bearing TSA No. 13/2025 without being influenced by any observation in the impugned order dated 09.04.2026 and shall decide each and every issue involve in accordance with law. It is also expected that the DRT-II, Delhi shall make every possible endeavour for expeditious disposal of S.A. bearing TSA No. 13/2025 as early as possible in accordance with law without giving any unnecessary adjournment. The appeal stands disposed of.
