Judgment
Before the hearing could begin today an additional affidavit has been filed by the respondent bringing on record certain additional facts which has come to their knowledge after the passing of the impugned order.
This additional affidavit has been seriously opposed and objected by the learned senior counsel for the appellant contending that additional affidavit filed in the midst of the hearing is only to stall the hearing.
Considering the objection raised, we are of the opinion that such additional affidavit which has been filed during the course of the hearing will not be taken into consideration.
We have heard Mr. Khambatta, learned senior counsel for the respondent. The argument is continuing. Put up tomorrow i.e.27th June, 2023 for further hearing.
