Judgment
The petitioner challenges Ext.P15 order passed by the Assistant
Educational Officer by which the 2nd respondent is appointed as
temporary Manager. The contention of the petitioner is that the order
Ext.P15 is passed in gross violation of the orders passed by this court.
Heard learned counsel for the petitioner and the learned
Government Pleader.
As Ext.P15 order is passed by the Assistant Educational
Officer, there is a statutory remedy available for the petitioner before
the District Educational Officer, Kozhikkode.
In the above circumstances, this writ petition is disposed of,
directing the petitioner to move the District Educational Officer,
Kozhikkode with appropriate appeal within a period of two weeks. On
receipt of such appeal, the District Educational Officer, Kozhikkode
shall consider the same and pass orders, after affording an
opportunity of hearing to the petitioner, 2nd respondent as well as the
Managing Committee of the Thrikkottur Vidyabhyasa Committee,
within a period of two months from the date of receipt of a copy of the
judgment. Till such time, the 1st respondent shall continue as Manager.
Petitioner shall produce a copy of this writ petition before the District
Educational Officer, Kozhikkode along with the copy of the judgment.
