WPSB No. 395 of 2017 filed by the petitioners was disposed of by Division Bench of this Court vide order dated 06.09.2017 by directing the first
respondent to take decision on petitioners’ representation, in accordance with law, within a period of six weeks.
Alleging disobedience of the said order, petitioner has filed this Contempt Petition.
A compliance affidavit has been filed by Mr. Ajay Kumar Mohanti, Joint Registrar, H.N.B. Garhwal Central University, Srinagar. In paragraph no.
4 of the said affidavit, it has been stated that the matter of implementation of Leave Encashment Scheme for the Teachers of the University was
referred to U.G.C. and, as & when instructions are received, U.G.C. Leave Encashment Scheme would be implemented.
Learned counsel for the petitioners has apprised the Court that, despite several reminders issued by the University, University Grants Commission
has not issued any instruction regarding implementation of Leave Encashment Scheme.
Since the Division Bench of this Court had directed the University to take decision regarding implementation of Leave Encashment Scheme and
there was no such direction to the University Grants Commission, therefore, instead of keeping this Contempt Petition pending on the file of this Court,
this Court thinks that ends of justice would be met, if the petitioners are permitted to approach the Secretary, University Grants Commission for taking
decision in the matter. If petitioners approach the Secretary, University Grants Commission, by making a representation within two weeks from today,
decision on petitioners’ representation shall be taken in the light of proposal submitted by Registrar, H.N.B. Garhwal University as early as
possible; but, not later than ten weeks from the date of receipt of representation alongwith certified copy of this order.
The Contempt Petition is, accordingly, disposed of
