Judgment
A specific direction had been issued on 16th December, 2022 that the proposal regarding upgradation of the school in question should be processed and an appropriate order should be passed by the SSEPD Department, Odisha by today, i.e., 1st March, 2023. The office notes show that the said order as corrected by the order dated 3rd January, 2023 was sent to the Secretary SSEPD Department on 9th January, 2023.
Today, Mr. Ishwar Mohanty, learned Additional Standing Counsel appearing for the State seeks some more time. There is, therefore, a prima facie disobedience to the order passed by this Court on 16th December, 2022.
A notice will be sent to the Secretary, SSEPD Department to explain why the order passed by this Court on 16th December, 2022 has not been complied with till date. An affidavit to that effect will be personally filed by the Secretary, SSEPD Department on or before 27th March, 2023. It will be the responsibility of the Registry to ensure that today’s order is communicated forthwith to the Secretary, SSEPD Department and a report of delivery of the order will be placed on record.
Mr. Ishwar Mohanty, learned ASC on his part will ensure that a copy of today’s order is in fact delivered to the Secretary, SSEPD Department for compliance.
The Court will take a very serious view of the matter if the non-compliance continues on the next date.
