By means of this writ petition, the petitioner has sought indulgence of this Court for issuance of a writ of mandamus commanding respondent nos.2 & 3 to issue the OBC caste certificate to the petitioner as she belongs to “Sonar” community.
Heard learned counsel for the parties.
It is the case of the petitioner that petitioner has applied for issuance of OBC caste certificate by making an online application through portal on 16.03.2024 to respondents, which is annexure 4 to the writ petition. The said application is still pending disposal for the last nine months, causing prejudice to the petitioner as she is unable to apply for various job/trainings.
An averment has been made by learned counsel for the petitioner in the writ petition that since no OBC caste certificate has been issued to the petitioner, therefore, she filed the present writ petition.
Learned counsel for the petitioner submits that if a direction is issued to the respondent authority to issue the OBC caste certificate to the petitioner within stipulated time, end of justice would met.
Learned counsel for the State has no objection to the said preposition.
In this view of the matter, the writ petition is disposed of. Respondent no.3-Tehsildar, Gairsain, District Chamoli (wrongly mentioned as Tehsildar Chamoli in writ petition) is directed to consider the case of the petitioner for issuance of the OBC caste certificate of “Sonar” community to her (petitioner) as per law within a period of two weeks from the date of issuance of this order.
