Judgment

This application under Section 439 of the Cr.P.C. has been filed on behalf of the applicants, who are in custody since 03.10.2020 in connection with
Crime No.614/2020 registered at Police Station Chorhata, District Rewa for offences punishable under Sections 147, 148, 149, 294, 323, 336 & 302 of
the Indian Penal Code.
Learned counsel for the applicants submits that the applicants are innocent, due to rivalry between the applicant and complainant parties, they are
falsely implicated in the case. Applicants are aged 19 years and they have minor children. Due to Covid-19, the trial would take considerable, hence it
is prayed that the applicants be enlarged on bail.
Learned Panel Lawyer for the State has opposed the application.
As per the case diary, there is no specific allegation against the present applicants with regard to the fact that they have actively participated in the
crime or assaulted to the deceased persons. Considering the role attributed to the present applicants and their custody period, without commenting
upon the merits of the case, this application is allowed.
It is directed that applicants namely Smt. Priyanka Pandey and Smt. Rachna Pandey be released on bail on furnishing personal bond in the sum of R s
. 50,000/- (Rupees Fifty Thousand only) each with one solvent surety each, in the like amount to the satisfaction of the concerned trial Court for their
appearance before the trial Court on the dates so fixed by that Court during trial.
The applicants shall comply with the provisions of Section 437 (3) of the Cr.P.C.
Accordingly, the application is allowed and disposed of.
