Manish Mathur, J

Heard learned counsel for petitioner, learned State Counsel for opposite parties 1, 5, 6, 7 & 8. In view of order being passed, notices to opposite parties 9 & 10 stand dispensed with.

Petition has been filed seeking a direction to the District Inspector of Schools to accord joining of petitioner on the post of Assistant Teacher (Trained Graduate Teacher) on the subject of Biology in the institution in question in pursuance to allotment order dated 21.10.2021, contained in Annexure-6 to the writ petition.

It is submitted that the petitioner has been allotted the subject of Biology.

Learned State Counsel submits that from a reading of the material on record, it appears that initially the petitioner was selected in the subject of Biology but subsequently on verification it came to knowledge that the petitioner had graduated in the subject of Bio-Technology and as such her selection for the subject of Biology appears to be incorrect since she did not have the essential subjects required for selection on the said subject. However, he has not yet been provided with any instructions in the matter.

Considering the aforesaid facts and submissions advanced by learned counsel for the parties, it is apparent that the aforesaid aspect is required to be considered by experts in the field. For the said purpose, petitioner is granted liberty to file a fresh representation to opposite part no.2, i.e. Secretary, Uttar Pradesh Secondary Education Service Selection Board, Prayagraj. Without entering into merits of the matter, it is provided that in case such a representation is made, the same shall be considered and decided by a reasoned and speaking order within a period of six weeks from the date a copy of this order is produced before said authority.

With aforesaid observations and directions, the petition is finally disposed of.
