Judgment
K. Kannan, J.—The petitioner challenges the selection of the private respondent as Lambardar of the village. While weighing the relative merits of the candidates, the Collector has acted on the recommendations of the Assistant Collector and found that the respondent was younger in age being 38 years and a matriculation pass while the petitioner is elder to him and was more than 80 years of age and even his claim to have passed 5th standard was without any proof. The only point urged before me is that the petitioner had served more than 9 years without any form of complaint and that the finding by the Collector that he was more than 80 years of age was erroneous when he was actually about 60 years. The previous experience is irrelevant in this situation, for the matter is related to a selection of new candidate and the issue further relating to age also does not assume significance, for when a relatively grading was made and when the respondent was seen educationally better qualified, it was merely a manner of appraisal that the respondent was relative younger and therefore, could be preferred. I do not find any reason for interfering with the findings entered by the Collector or the Deputy Commissioner.
The orders are confirmed and the writ petition is dismissed.
