Judgment

Learned counsel for the respondent no. 1 submits that by reference to an interim order dated 20.12.2022 passed by this Court, the Management of Maharaja Hari Singh Agricultural Collegiate School Nagbani enabled itself purportedly to relieve the respondent no. 1 from her posting place in the Maharaja Hari Singh Agricultural Collegiate School Nagbani for the purpose of reporting to the place of transfer in the Maharaja Hari Singh Agricultural Collegiate School, R. S. Pura.
Learned counsel for the respondent no. 1 submits that by the said purported action and stand of the Management of the Maharaja Hari Singh Agricultural Collegiate School Nagbani, the respondent no. 1 literally would be non-suited in the matter and her request to the Management concerned to acknowledge her reporting for the duty in the Maharaja Hari Singh Agricultural Collegiate School Nagbani is being avoided by the Management. Learned counsel for the appellant submits that let the case be heard on merits.
List this case for consideration on 19.01.2023.
In the meantime, the respondent no. 1 shall be deemed to be on duty by the Management concerned of the Institution in Nagbani without counting her to be absent from duty till further orders to contrary from this Court.
