Judgment
The petitioner has field the present petition claiming for regularization with effect from his initial date of appointment along with all consequential pecuniary benefits. It has further been claimed that he be extended the benefits of time bound promotion and fixation of his salary and payment of leave encashment etc.
Learned counsel for the petitioner submits that the issue involved in this case has already been decided by this Court in W.P. No. 2742/2012 (S)- Dr. Ramesh Chandra Dixit Vs. State of MP and another vide order dated 04.04.2012. This Court while disposing of the said writ petition has issued following directions:- "55. Accordingly, for the grounds and reasons indicated hereinabove, all these petitions are allowed. Respondents are directed to consider the case of the petitioners for grant of senior scale/selection grade after treating the services rendered by the petitioners from the initial date of appointment as emergency appointee as ''regular appointment'' for the purpose of conferring the benefit of senior pay scale and selection grade. Matters be placed before the appropriate screening committee and based on the recommendations of the screening committee, the benefit be extended retrospectively with effect from the date of eligibility of each of the petitioners."
Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the aforesaid directions. He, therefore, prays that the writ petition may be disposed of with a direction to the respondents to consider the case of the petitioner in light of the directions given by this Court in the case of Dr. Ramesh Chandra Dixit (supra).
Learned panel lawyer appearing on behalf of the respondents/State does not opposes the said prayer.
In light of the aforesaid submissions made by learned counsel for the parties, the petition filed by the petitioner is disposed of with a direction to the respondents to consider the case of the petitioner in light of the judgement dated 04.04.2012 passed by this Court in W.P. No. 2742/2012 (S). The aforesaid exercise be carried out within a period of three months thereof and if the petitioner is found eligible, then the respondents are directed to extend all the benefits which have been given to the other similarly situated persons.
With the aforesaid observations, the writ petition stands disposed of with no order as to costs.
