Premvati and Others vs State of Punjab and Another

Mahesh Grover, J.—The petitioners pray for quashing of FIR No. 119 dated 11.7.2012 registered at Police Station Beas, District Amritsar vide which he is facing prosecution u/s 304B IPC, on the ground that the matter has been compromised between the parties. Even though the Full Bench of this Court in a judgment rendered in Kulwinder Singh and Others Vs. State of Punjab and Another, and subsequent judgment of the Hon''ble Supreme Court rendered in Gian Singh Vs. State of Punjab and Another, do laid down the guidelines for quashing of FIRs on the basis of compromise in order to enhance the peace in the society, yet exceptions have been carved out to prohibit the exercise of power u/s 482 Cr.P.C. to quash FIRs on the ground of compromise if they relate to serious offences and offences against the society.

Finding this to be one of those cases where a young girl has lost her life in her matrimonial home, I am of the opinion that power u/s 482 Cr.P.C. cannot be exercised in favour of the petitioners. Dismissed.
