By our order dated November 17, 2022, we had dismissed the appeal since the amount that was required to be paid in terms of our order dated August 24, 2022 was not complied with by the appellant. Through this recall application, we have been informed that the balance amount of Rs. 12,45,330/- towards GST has also been paid on December 31, 2022. In view of the aforesaid, cause shown is sufficient. The order is recalled. The appeal is restored to its original number.
We have heard the learned counsel for the parties. The appeal was filed against the delisting order on account of non-payment of SOP fine. Pursuant to our various orders, the appellant had paid the entire amount and, therefore, the delisting order no longer survives.
In view of the aforesaid, we set aside the impugned order of delisting. The appeal stands allowed.
This order will be digitally signed by the Private Secretary on behalf of the bench and all concerned parties are directed to act on the digitally signed copy of this order. Certified copy of this order is also available from the Registry on payment of usual charges.
